Personal Injury: Glossary of Terms

Bad Faith: To mislead insured individuals with certain actions.

Damages: Monetary compensation that is awarded to an injured individual by a jury or court.

Insurer: The insurance company or underwriter that is involved in a contract of insurance.

Liability: Fault or responsibility for an accident or other type of incident that results in damage to property and/or injuries to a person.

Litigation: The process in which a lawsuit is filed and then defending against it or prosecuting it.

Negligence: Another term used to describe carelessness.

Party: An individual, government agency or company that is actively involved in the defense or prosecution of a legal proceeding.

Third Party: An individual, government agency or company that is not actively involved in the defense or prosecution of a legal proceeding.

Tort: Generally, in civil law, a tort refers to an injury or wrong committed against property or an individual, but does not include breach of contract.

Witness: Someone who testifies to what they have heard or seen. A witness can also be someone who is there during the signing of a will and can testify that it's the will maker's intended last will and testament.
